ส่งนักเรียน16 ปีชูป้าย"ผมเห็นคนตายที่ราชประสงค์"เข้า"สถานพินิจ"หลังถูกสอบเครียด

จากกรณีที่มีกลุ่มนักเรียนนักศึกษานำโดย นายธนิต บุญญนสนีเกษม แกนนำกลุ่มพลังมวลชนเชียงราย นายกิตติพงษ์ นาตะเกศ อายุ 24 ปี นายนิติเมธพนฎ์ อายุ 23 ปี นักศึกษามหาวิทยาลัยราชภัฏเชียงราย และนักเรียน อายุ 16 ปีโรงเรียนดำรงราษฎรสงเคราะห์เชียงราย ถูกออกหมายจับในข้อหาชุมนุมหรือมั่วสุมกันตั้งแต่ 5 คนขึ้นไป หรือกระทำการใดอันเป็นการยุยงให้เกิดความไม่สงบเรียบร้อย ภายในเขตพื้นที่ที่หัวหน้าผู้รับผิดชอบประกาศพระราชกำหนด, ร่วมกันเสนอข่าว, ทำให้แพร่หลายซึ่งสิ่งพิมพ์หรือสิ่งอื่นใดที่มีข้อความอันอาจทำให้ประชาชน เกิดความหวาดกลัวหรือเจตนาบิดเบือนข้อมูลข่าวสารทำให้เกิดความเข้าใจผิดใน สถานการณ์ฉุกเฉิน
กลุ่มนักเรียนและนักศึกษาดังกล่าวได้ถือป้ายแสดงข้อความต่างๆ เช่น "ผมเห็นคนตายที่ราชประสงค์" "นายกครับอย่าเลิก พ.ร.ก.ฉุกเฉินนะครับ ไม่งั้นรัฐบาลจะพัง" และ"พ.ร.ก.ฉุกเฉินต้องคงไว้เพื่อไม่ให้ความจริงปรากฏ" โดยกลุ่มนักเรียนทั้งหมด สวมหน้ากากอนามัยเพื่อปิดบังใบหน้า พร้อมเขียนข้อความไว้บนหน้ากากอนามัยว่า พ.ร.ก. ส่วนเสื้อที่สวมใส่ก็ได้มีการเขียนว่า "ปรองดอง""ไม่รักรัฐบาลทรราช"โดยถือป้ายที่บริเวณตลาดสดเทศบาล 1 และปากทางขึ้นศาลากลาง จ.เชียงราย จนถูกออกหมายจับดังกล่าว
พ.ต.ท.บัญญัติ ทำทอง รักษาราชการแทน รอง ผกก.สส.สภ.เมืองเชียงรายกล่าวว่า นายธนิตยังมีส่วนเกี่ยวข้องกับการเคลื่อนไหวโดยติดต่อกับกลุ่มนัก เรียนนักศึกษาทางเฟซบุ๊กด้วย ซึ่งทางตำรวจเห็นว่าเข้าข่ายกระทำความผิด เพราะพื้นที่ยังประกาศใช้ พ.ร.ก.ฉุกเฉิน
ล่าสุดนักเรียนอายุ 16 ปี หนึ่งในผู้ที่ออกหมายจับได้เข้ารายงานตัวกับสถานพินิจที่จังหวัดเชียงรายและถูกเรียกให้พบอีกครั้งในวันที่ 30 ก.ค.นี้ แม่ของนักเรียนอายุ 16 ปี เปิดเผยกับ "มติชนออนไลน์" ว่า ในวันเกิดเหตุวันที่ 16 ก.ค.ครูที่โรงเรียนลูกชายโทรมาแจ้งให้พาลูกชายไปพบที่โรงเรียนแม่ก็บอกว่าไม่รู้เรื่องลูกชายไปชูป้าย และตอนนั้นครูแจ้งว่าไม่ผิดหรอกที่จะทำแต่ไม่ควรใส่เสื้อนักเรียนที่มีป้ายชื่อสถาบันไป จึงไม่ได้คิดอะไรก็พาลูกกลับบบ้าน
"เวลาประมาณ 17.00 น. พ.ต.ท.บัญญัติ ทำทอง โทรมาขอเบอร์สามีจึงบอกไปว่าอยู่กรุงเทพฯ 2-3 เดือนถึงจะลงมาสักครั้งหนึ่ง จากนั้นจึงโทรไปหาสามีว่าจะมีตำรวจโทรไปหายังไม่ทันคุยจบ ก็ได้ยินเสียงคนเดินเข้ามาในบ้านเพราะว่าประตูรั้วเปิดแง้มไว้ จึงวางโทรศัพท์แล้วออกไปดูพบว่ามีชาย 3 คนเข้ามาในบ้าน แล้วแจ้งว่าเป็นตำรวจนอกเครื่องแบบมาตรวจสอบมาสอบถามเรื่องลูกชายว่ามีใครชักชวน ซึ่งลูกชายก็บอกว่ารู้จักกันทางเฟซบุค และตำรวจขอดูโน้ตบุคของลูกชายแต่ก็ไม่พบอะไร แล้วตำรวจเชิญไปโรงพัก แต่เราไม่ไปเพราะเวลานั้นใกล้ค่ำแล้วจึงบอกว่า ขอไม่ไปได้ไหมเพราะค่ำแล้ว และถ้าจะให้ไปจริงขอหมายเรียกมาก่อน แล้วตำรวจนอกเครื่องแบบก็กลับไป
หลังจากตำรวจทั้ง 3 นายกลับไป พ.ต.ท.บัญญัติ โทรมาแจ้งว่าจะมาที่บ้าน และมาพร้อมกับผู้หญิงคนหนึ่งมาค้นข้อมูลจากโน้ตบุค พูดขึ้นว่า พอตำรวจเข้าบ้านมาก็ส่งข้อมูลให้เพื่อนทางเฟซบุคเลย กลัวว่าเรื่องจะบานปลายจึงขอร้องว่าดึกแล้วให้ตำรวจกลับไปก่อน ผ่านไป 2 วันไม่มีอะไรเกิดขึ้น
วันที่ 18 ก.ค.ตรงกับวันอาทิตย์ห่วงลูกจึงพาไปทำงานด้วย ตอนเย็นมีตำรวจโทรมาบอกว่าจะไปหาที่บ้านตอน 1 ทุ่ม จึงบอกไปว่าไม่อยู่บ้าน เพราะตอนนั้นกลัวมาก จึงพาลูกชายไปอยู่ที่บ้านเพื่อนก่อนรอจน 3 ทุ่มจึงเข้าบ้านไป ตอน 1 ทุ่มกว่าๆให้ลูกไปดูหน้าบ้านเห็นรถติดไฟไซเรนจอดอยู่ใกล้ๆ บ้านจึงพากันไปกินข้าวรอให้ดึกก่อนถึงกลับเข้าบ้าน พอกลับถึงบ้านก็ไม่พบรถคันดังกล่าวแล้ว
เช้าวันจันทร์ที่ 19 ก.ค. มีตำรวจโทรเข้ามาบอกว่าให้เปิดประตูบ้านเพราะมีหมายเรียกและหมายค้น จากนั้นตำรวจเข้ามาถ่ายภาพห้องนอนลูกชายและยึดโน้ตบุ๊คลูกชายไป แจ้งว่าเวลา 10.00 น. วันที่ 20 ก.ค.ให้ไปที่สถานีตำรวจ รุ่งขึ้นจึงพาลูกชายไปที่สถานีตำรวจแล้วทางตำรวจก็ส่งลูกชายไปที่สำนักงานอัยการเพื่อสอบปากคำ ในวันนั้นมี อัยการ นักจิตวิทยา ทนายความ ตำรวจ และนักสิทธิมนุษยชน สอบสวนซักถามลูกชาย ความรู้สึกของแม่ตอนนั้นคือไม่รู้จะทำอะไรได้นอกจากคอยอยู่ใกล้ๆลูกชาย คิดว่าลูกชายคงกดดันมาก แต่เขาก็ตอบไปตามความจริงเรื่องที่ไปชูป้ายกับรุ่นพี่ที่รู้จักกันผ่านทางเฟซบุค จากนั้นก็แยกย้ายกันกลับ
วันเดียวกันเวลาประมาณ 6 โมงเย็น มีตำรวจจโทรมาว่าวันที่ 21 ก.ค.จะพาลูกชายไปส่งสถานพินิจ ตอนนั้นตกใจมากแต่ก็คิดว่าคงไม่มีอะไร พอรุ่งเช้าก็แต่งตัวรอแล้วทางตำรวจก็แจ้งว่าให้พาลูกไปเองไม่มารับแล้ว และย้ำว่าไม่ต้องพาใครไปด้วยให้ลูกชายแต่งชุดนักเรียน แล้วทางสถานพินิจก็ให้ลูกชายไปพบพนักงานควบคุมควมประพฤติเซ็นชื่อแล้วก็กลับบ้านไม่ได้มีการสอบสวนอะไร และแจ้งว่าในวันที่ 30 ก.ค.ให้พาลูกชายมาอีกครั้งและให้พาไปตรวจร่างกาย
วันที่ 30 ก.ค.ไม่รู้ว่าจะเรียกไปทำอะไร คิดไว้ว่าถ้าลูกชายถูกควบคุมตัวก็จะดำเนินการประกันตัวออกมา สงสารลูกชายมาก เมื่อก่อนนอนแยกห้องกันหลังจากเกิดเรื่องลูกชายมานอนกับแม่ ทั้ง 2 คนไม่มีใครนอนไม่ค่อยหลับเลยได้แต่นอนกอดกันฟังเสียงลมหายใจ พอลูกชายหลับไปก็สะดุ้งตื่นดิ้นมือไขว่คว้าหาแม่ตลอด แม่เองก็กินไม่ได้นอนไม่หลับพ่อที่ทำงานอยู่กรุงเทพฯก็เป็นทุกข์" แม่นักเรียนอายุ 16 ปี กล่าว
ขณะที่นักเรียน ม. 5 ให้สัมภาษณ์ว่า ตอนนี้ถูกเรียกไปไหนก็ต้องไป แต่ก็เชื่อว่าสิ่งที่กระทำลงไปไม่ผิดเพราะเป็นการแสดงความคิดเห็นเท่านั้นวันที่ไปชูป้ายข้อความว่า "ผมเห็นคนตายที่ราชประสงค์" เป็นการแสดงความคิดเห็นของตนเองจึงคิดว่าไม่ผิดเพราะมีคนตายจริงๆ ข่าวที่ปรากฎตามสื่อก็มี ตอนนี้รู้สึกเครียดเหมือนกันแต่เรื่องราวมาถึงขนาดนี้แล้วก็คงต้องทำใจปล่อยไปตามเรื่องตามราวที่จะเกิดขึ้น เขาเรียกไปสถานพินิจก็ต้องไป
"ผมไม่กลัวเพราะผมไม่ผิดผมไม่ได้ไปกระทำผิดเรื่องร้ายแรงอะไร การไปชูป้ายเป็นแค่การแสดงความคิดเห็นจึงคิดว่าไม่น่าจะโดนอะไร ไปกับพี่ที่ติดต่อกันทางเฟซบุค และตกใจเหมือนกันที่เห็นตำรวจมาที่บ้านเข้ามาในบ้านแบบไม่ทันตั้งตัว มาค้นข้อมูล" นักเรียนม.5 กล่าว
ทางด้านคณะกรรมการสิทธิมนุษยชน น.ส.เกศริน เตียวตระกูล คณะอนุกรรมการในคณะอนุกรรมการสิทธิมนุษยชนแห่งชาติ ด้านสิทธิพลเมืองและสิทธิทางการเมือง กล่าวถึงกรณีนี้ว่า ตนเห็นว่าการถือป้ายลักษณะดังกล่าว เป็นสิทธิเสรีภาพในการคิด เด็กอายุ 16 ปี ก็มีความคิดได้เช่นกัน ดังนั้น จะรวบรวมข้อมูลทั้งหมดนำเสนอต่อคณะกรรมการสิทธิมนุษยชนแห่งชาติ (กสม.) ต่อไป

Matichon Online reported this extraordinary story about what may happen during the time of emergency decree.
The topic of the story reads; "A 16 year-old student who held a banner that said 'I saw dead people at Ratchaprasong' got sent to a youth detention center".
In Chiang-Rai Province, three students were issued arrest warrants for violating the emergency decree. Two of them are university students aged 24 and 23. One of them is still a 16 year-old student studying at a school level. The arrest warrants came as a result of their participation in a protest campaign against the government. Together in a group of five students, they were holding banners in Chiang-Rai's public locations conveying messages such as; "I saw dead people at Ratchaprasong"; "To our PM, please keep the emergency decree, otherwise the government would fall"; and "The emergency decree is needed to cover-up truth. A police officer dealing with this case stated that this group of students had contacted each other through facebook.
The 16 year-old student just went to report himself to a youth detention center, and was told to report himself there again on July, 30.
His mother told Matichon about what happened to her son. She said that, on July 16, the day her son participated in the protest, a teacher at her son's school told her to bring her son to meet him/her at the school. However, the teacher told her that her son did not do anything wrong; but just did something inappropriate by wearing his school uniform during the protest. However, around 5pm on the same day, when she were already back home with her son, the police called her to ask for her husband number. And shortly after, a group of three plain-clothes policemen went into her house to asked her and her son about the protest. Her son told the police that he joined the protest together with friends he knew from facebook. The policemen then checked his laptop, and subsequently asked her and her son to go a police station. She refused to go, arguing that it was already very late in the night. She told the policemen that she will bring her son to the police station when they have a summon. The three policemen then left the house.
However, not long after the three policemen left, another police officer called her and came to her house with one woman. The woman then checked her son's laptop again, and said; "right after the police came to the house, her son sent the information to friends on facebook". Again, she (the mother) asked that police officer to leave, telling them that it was already very late.
Two days later, on July, 18, the police called her again, telling her that they will come to her house at 7pm. She responded by saying that she and her son will not be at home during that time. She and her son then stay away from home until very late. In the morning of the July, 19, the police called her and told her to open the house's gate since the police already has a summon and a search warrant. The police then went into her house. They took photos of her son's bedroom, and took away her son's laptop. The police informed her that she had to bring her son to the police station on a following day (July, 20).
On July, 20, she took her son to the police station. The police sent her son to an attorney's office for investigation. Her son had to meet with an attorney, a psychologist, a lawyer, the police, and a human-rights activist. She said her son must be under a huge pressure. But her son had just answered questions base on a true story that he only went to hold the banners with senior friends that he knew through facebook, and subsequently, they just separated and went home. The police then called her in the evening that they will take her son to a detention center on July, 21. She was shocked, but hoped things would not be too serious. In the morning of July, 21, the police told her to take her son to a detention center by herself. After they arrived at a detention center, her son had to meet the detention officers, signing papers. Then he was allowed to go home. He is required to report himself at a detention center again on July, 30. In addition, the mother was told to take her son to do a medical check.
She (the mother) said she still does know what will happen on July, 30. If her son is detained, she will try to bail him out. She said she really feels sorry for her son. Her son had to come to sleep in her room since the incident, and they have not been able to sleep well at all. Her son kept on waking up at night frightened. She and her husband have been in a trauma.
The 16 year-old student was also interviewed by Matichon. He said now he has to go wherever his is summoned. He, however, still thinks what he did was not wrong since he only expressed his opinion. Moreover, the banner he held, which said "I saw dead people at Ratchaprasong", only expresses fact. That cannot be wrong since people actually died there, and there were news about this. He is very stressful at the moment, but will have to let whatever will be, will be.
TP: if the message like "I saw dead people at Ratchaprasong" is considered a threat to security, then that really signifies whose security this emergency is protecting.
